Terms of Service

1. Agreement to Terms

By accessing or using CallFlow ("the Service"), operated by Topicer Pty Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

2. Description of Service

CallFlow is an AI-powered phone answering service that answers calls on behalf of your business, records and transcribes conversations, and delivers call summaries via SMS and dashboard. The Service is provided on an "as is" and "as available" basis.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Subscriptions and Billing

  • Subscriptions are billed monthly in advance at the rate applicable to your selected plan.
  • No lock-in contracts. You may cancel your subscription at any time.
  • No refunds. Upon cancellation, your access continues until the end of the current billing period. No pro-rata or partial refunds will be issued.
  • We reserve the right to change pricing with 30 days' notice.

5. Call Recordings and Data

  • All inbound calls handled by CallFlow are recorded and transcribed.
  • Recordings are stored securely and available via the dashboard for your retrieval.
  • We may use anonymised and aggregated call data for product improvement, AI model training, and service optimisation.
  • You are responsible for informing your callers that calls may be recorded where required by law. CallFlow includes a brief disclosure at the start of each call, but compliance with local recording consent laws remains your responsibility.

6. Acceptable Use

You must not use the Service for any unlawful purpose, to transmit harmful or offensive content, or to interfere with the Service. We may suspend or terminate accounts that violate these terms without notice or refund.

7. Limitation of Liability

  • The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee the Service will be uninterrupted, error-free, or that all calls will be answered or transcribed accurately.
  • Our total aggregate liability for any claim is limited to the amount you paid in the calendar month in which the claim arose.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages including loss of profits, revenue, business, data, or goodwill.
  • We are not liable for losses arising from missed calls, inaccurate transcriptions, system downtime, or actions taken based on information provided by the Service.

8. Indemnification

You agree to indemnify, defend, and hold harmless Topicer Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

9. Service Modifications

We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation.

10. Termination

We may terminate your account at our sole discretion without prior notice for conduct that violates these Terms. Upon termination your access ceases immediately with no refund.

11. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of South Australia.

12. Communications

By creating an account, you consent to receive transactional emails (account notifications, call summaries) and occasional marketing communications. You may unsubscribe from marketing emails at any time.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or dashboard notice.
